                  To have the National Guard for the same objects, in the terms that section IV of Article 76
                  prevents.





                  While,  under  Article  76  of  the  Constitution  (Exclusive  Powers  of  the  Senate),  the  High

                  Chamber has the power to:


                  Give  consent  for  the  President  of  the  Republic  to  have  the  National  Guard  out  of  their

                  respective States, establishing the necessary force.





                  It should be noted that, despite the National  Guard is embodied in seven articles of the
                  Constitution,  lacking  a  statutory  law,  only  appears  as  a  dead  letter  in  the  Basic  Law  of

                  Mexico.


                  Although for the Secretariat of National Defense of Mexico (2001: 379), internal security is

                  the "Providence adopted to maintain the peace of the Nation", there is a legal gap and lack of
                  definition of that security category in Mexico.


                  Wherefore, it is convenient to take advantage of the doctrine developed by the International

                  Committee of the Red Cross (ICRC), focusing on situations of domestic violence that are

                  defined as internal disturbances and internal tensions, in which the police are often exceeded
                  in their dissuasive capacity and reactive, forcing the efforts of the military to restore internal

                  order  and  public  tranquility.  (Harroff-Tavel,  1993)  Subsequently,  in  a  document  entitled
